§ 19983 Severability Of Provisions

Key Takeaways

  • •If a court says part of this law is invalid because it conflicts with the Political Reform Act of 1974, the rest of the law still stands.
  • •The invalid part only affects the specific case or situation it was used in, not the whole law.
  • •Other parts of the law and other people or situations are not affected by this decision.

Example

Imagine a law says you can't have loud parties after 10 PM, but a court says that rule is invalid because it conflicts with another law about noise.

Even if the court says the loud party rule is invalid, the rest of the law (like rules about trash or parking) still apply. Only the loud party rule is affected, and only for the person or situation in that specific case.

(Added by renumbering Section 19960.4 by Stats. 2002, Ch. 738, Sec. 125. Effective January 1, 2003.)
