§ 14272 State Trademark Registration

Key Takeaways

  • •This law is about registering and protecting trademarks in the state, similar to how the federal government does it.
  • •It follows the same rules as the federal trademark law (Trademark Act of 1946).
  • •If you're unsure how this law works, you can look at how the federal law is interpreted for guidance.

Example

You start a small business selling homemade jam under the name 'Grandma’s Sweet Delight' and want to protect that name so no one else in the state can use it.

This law lets you register 'Grandma’s Sweet Delight' as a trademark in the state, just like you could with the federal government. It helps stop others from copying your business name.

§ 14272 State Trademark Registration

The intent of this chapter is to provide a system of state trademark registration and protection substantially consistent with the federal system of trademark registration and protection under the Trademark Act of 1946 (15 U.S.C. Sec. 1051 et seq.), as amended. To that end, the construction given the federal act should be examined as nonbinding authority for interpreting and construing this chapter. (Added by Stats. 2007, Ch. 711, Sec. 2. Effective January 1, 2008.)
