§ 110 Department Property Control

Key Takeaways

  • •The department owns and controls everything used by its offices and workers, like papers, computers, money, and land.
  • •All this stuff officially belongs to the State of California, not the individual offices or workers.
  • •The department can't see or control test questions before they are given to people taking the test, unless a board says it's okay.

Example

A state office buys new computers for its workers.

Those computers don’t belong to the office or the workers—they belong to the State of California, and the department is in charge of them.

The title to all property held by any of these bodies, offices or officers for the use and benefit of the state, is vested in the State of California to be held in the possession of the department. Except as authorized by a board, the department shall not have the possession and control of examination questions prior to submission to applicants at scheduled examinations. (Amended by Stats. 1996, Ch. 829, Sec. 1. Effective January 1, 1997.)
