§ 10100 License Suspension Procedures

Before the department can suspend, cancel, or refuse a license, it must follow the step‑by‑step rules in Chapter 5 of the Government Code, and if it says no to a license application it must follow Sections 485‑488.

Key Takeaways

  • •The department can’t just suspend or cancel a license; it must follow the detailed steps in Chapter 5 of the Government Code.
  • •When the department denies a license application, it must use the process in Sections 485‑488.
  • •The department has all the authority that those referenced sections give it.

Example

A plumber applies for a new specialty endorsement on his license, but the department finds he didn’t meet the requirements and decides to deny the application.

Because the department is saying no, it has to follow the exact process laid out in Sections 485‑488 of the law. If later the department wanted to take away his existing license, it would have to use the procedures in Chapter 5 (starting at Section 11500) and would have all the powers that chapter gives it.
